Sözleşmeli er ve erbaşlar memuriyet haklarını istiyor

Sözleşmeli er ve erbaşlar haklarının korunmasını talep ediyorlar. 2011’de yürürlüğe giren düzenleme ile 7 yıl görev sonunda kamudaki kadrolara atama yolu açılan sözleşmeli erler, yönetmelik çıkmadığı için bu haktan yararlanamıyor. Bu nedenle haklarının tanınmasını sözleşmeli er ve erbaşlar kadrolu atama yoluna geçmek istiyorlar.

Milli Savunma Bakanlığı tarafından Kasım 2011 yılında uygulanmaya başlanan Sözleşmeli Er ve Erbaş Kanunu ile TSK’ya personel alımı başlayalı 11 yılı geçti. 2013 yılında yeni bir düzenleme yapılarak bu personele “memuriyet” hakkı tanındı. Ancak bu hakka kavuşamayan er ve erbaşlar, memuriyet hakkının tanınmasını istiyor. Sosyal medya ve basın yolu ile seslerini duyurmak isteyen er ve erbaşlar artık kendilere tanınan kadrolu hakkın biran önce yürürlüğe girmesini talep ediyorlar.

Sözleşmeleri er ve erbaşlar, görev sürelerini 7 yıl doldurduklarını ve kanunda belirtilen ”7 yıl sonunda kamudaki boş kadrolara atanır” maddesi artık yürürlüğe girmesini istiyorlar. Yönetmeliğin çıkmasını ve artık sözleşmeli olan iş yükümlülüklerinin kadroluya geçmesini talep ediyorlar.

6191 Sayılı Sözleşmeli Er Erbaş Kanununun kamuda istihdam maddesinin 4 yıldır uygulanmadığını dile getiren erler, “Sözleşmeli er uygulamasının başladığı 2011 yılında, sözleşme süresinin kısalığı ve tazminat oranının düşük olması nedeniyle istenilen başvuru sağlanamayınca yeni bir düzeme yapılmıştı. Sözleşmeli erlerden 7 sene görev yapanlar kamu kurum ve kuruluşlarına memur olarak atanacaklardı. Ancak yönetmelik çıkarılmadığı için atama yapılamıyor” diye konuştu.

Yönetmenliğin bir an önce uygulanmasını isteyen erler, verilen sözlerin tutulmasını ve memuriyet haklarının tanınmasını istiyorlar. Bu nedenle isteklerini hem basın yoluyla hem de medya kanallarında yazılı ve sözlü olarak ifade ederek kendilerine tanınan bu hakların verilmesini rica ediyorlar…

KAMU KURUM VE KURULUŞLARINDA ÇALIŞAN SÖZLEŞMELİ PERSONEL VE MALULLER DERNEĞİ (SÖZPER-MALUL-DER) GENEL BAŞKANI ABİDİN KOCABUĞA, BASIN YOLUYLA YÖNETMELİĞİN YERİNE GETİRİLMESİ İÇİN MİLLET VEKİLLERİNE SESLENMDİ.

6191 Sayılı Sözleşmeli Erbaş ve Er Kanununun Uygulanamaması hakkında açıklama yapan SÖZPER-MALUL-DER GENEL BAŞKANI ABİDİN KOCABUĞA, şu sözlere yer verdi:

”Sayın Milletvekilim,

Derneğimiz 2018 yılında Eskişehir ilinde kurulmuştur. Türk Silahlı Kuvvetlerinde görev yapan yaklaşık 40.000 civarı Sözleşmeli Erbaş ve Erlerin; mali, sosyal ve özlük haklarını savunmak ve bu yönde iyileştirmeler yapılması amacıyla mücadele etmekteyiz.

Sözleşmeli erbaş ve erlerimiz 7 yıl boyunca Doğu ve Batı Garnizonlarında görevlerini kahramanca yaptılar, onlarca sözleşmeli erbaş ve er kardeşimizin vatan savunmasında çıkan çatışmalarda yaralanarak gazilik ve şehitlik makamına ulaştılar. Kısacası vatanımızı korumak için her şeyi yaptılar ve biz de dernek olarak sözleşmeli erbaş ve erlerin sorunlarını dile getirmek, sizin meclisteki ilgili mercilere ve Sayın Cumhurbaşkanımıza sesimizi duyurmamızda yardımcı olmanızı istiyoruz.

Sözleşmeli erbaş ve erlerin birçok konuda yaşadığı sorunlar var ancak şu anki en belli başlı sorunlardan ilki 7 yıl görev süresini tamamlamış sözleşmeli erbaş ve erlerin, hali hazırda kanuni hakları olan memuriyete geçiş hakkı yönetmeliğin çıkarılmaması nedeniyle bu haktan yararlanmamasıdır.

EK MADDE 1 – (Ek: 13/7/2013-6496/5 md.) “(1) Sözleşmeli erbaş ve er olarak en az yedi hizmet yılını doldurarak ayrılanlardan nitelik belgesi olumlu olanlar, ilgili mevzuatlarındaki şartları taşımaları kaydıyla kamu kurum ve kuruluşlarının boş kadro ve pozisyonlarına bu maddedeki usul ve esaslar çerçevesinde atanırlar.”

Yukarıdaki kanun maddesinde belirtildiği gibi 7 hizmet yılını doldurarak ayrılanların kamu kurulışlarına atanma hakkı doğmaktadır. 7 yıl görev süresini tamamlayıp memurluk hakkından yararlanmayı bekleyen yaklaşık 1500 personel vardır. Görev süresini tamamlayan erbaş ve erlerin memur olarak atanmaları için bir yönetmelik çıkarılması gerekmektedir. Bu yönetmelik Genelkurmay Başkanlığınca hazırlanmıştır ancak Milli Savunma Bakanlığı henüz yönetmeliği çıkarmamış ve Cumhurbaşkanlığı makamına sunulmadığı için yürürlüğe koyulamamıştır. Dernek olarak, görev süresince vatanını canı gibi koruyan sözleşmeli erbaş ve erlerimizin memurluk haklarının verilmesi için Milli Savunma Bakanlığının yönetmeliği çıkartarak Cumhurbaşkanlığı onayına sunması için desteklerinizi bekliyoruz.
